Note. The symbol "SP" heads the
articles and varieties of present regulations needed to fufill national
and regional legislation in Spain.
Chapter 1. General
provisions
Article 1. Scope
- The present regulations complement and extend freedoms of Direct
Democracy included by national and regional legislation, being
applicable to municipal scope.
- These regulations detail freedoms of Direct Democracy enjoyed by
people of this town. They include several institutional and popular
initiatives leading to binding referendum.
- The political freedom of Participative Budget is regulated
separately by its own regulations.
- Municipal associationsm is regulated separately by the
Regulations on Citizen Participación.
Article
2. Agreements
- Within these regulations the term "active electoral body" is a
number of citizens calculated as the mean turnover of the last four
municipal elections.
Chapter 2. About binding referendum
Article 3. Binding nature
- Decision taken in referendum is binding on all municipal
authority. Consultive nature will only exist within the special
circumstances stated by these regulations, o when regional or national
legislation forbid explicitly the binding nature.
- Binding nature of a decision taken in referendum requires a
turnover upper to 50% of the active electoral body.
- Questions under referendum will be headed by following legend: "Every municipal authority is bound by the
decision of this referendum except for the regulated special
circumstances".
Article 4. Object of referendum
- In general, every municipal areas of competence can be object of
referendum, including its competence to appear before other
institutions.
- Objects of municipal referendum will be too what stated
explicitly by national or regional legislation.
Article 5. Exclusions
- If people of this town enjoy the political freedom of
Participative Budget, decisions with budget nature will be excluded as
object of referendum. Or else, following criteria will be applicable:
- Initiatives on current annual municipal budget are excluded as
object of referendum, and on the approved one for next year.
- Every budgetary decision with multiannual nature can be object
of referendum. The result of referendum will be not binding for current
and next year.
- Allocation of budgetary minima for a specific area can be
object of referendum. The decision taken in referendum will be binding
for eight budgetary years.
- Decisions outside the municipal scope are excluded as object of
referendum. However, object of referendum can be every issue raised in
terms of political position or attitude of town's people, without
restrictions; in this case the binding nature is viewed as municipal
institutions will assume officially the decision taken in referendum.
- For four years, every initiative including total or partially a
decision taken in referendum already. The term will be calculated by
means of referendum's date and the date of the new petition.
- Exclusions will be considered by the Municipal Council of DD.
Article 6. Veto referendum
- No municipal institution or authority can veto execution of a
referendum.
- If national or regional legislation forbids explicitly the
binding nature of some kind of referendum, the question under
referendum replaces the top legend by: "Due to legal imperative this referendum is
not binding". If Town Council does not oppose explicitly, the
legend will be completed with: "The
Town Council considers itself politically bounded with the decision of
this referendum except for the regulated special circumstances".
- [SP] To fulfil the Article
71 of the Law 7/1985 Regulating the Foundations of the Local Regime,
Government willbe asked for authorization to hold the referendum
described in paragraph 4 of Article 15. If when date of referendum
come, mentioned authorization is not got or referendum had been
forbidden, the top legend will be replaced by: "Due to legal imperative this event is not
considered as a referendum, nor is legally binding". In this
case, if Town Council does not oppose explicitly, the legend will be
completed with: "The Town Council
considers itself politically bounded with the decision of this Public
Poll except for the regualted special circumstances". In this
case, the Municipal Council of DD will issues orders to replace the
term "Referendum" by "Public Poll".
Article
7. Text of the decision under referendum
- There will be a sole question, with a sole answer.
- In general, the expression will allow the answers "Yes" or "No",
or another expression which answer exhibits clear separate means.
- Municipal Council of DD could allow expressions for referendum
with no more than four answers when decision has numerical nature.
- For some specific classes of initiative, these regulations states
the concrete text of the answer. For the rest former precepts will be
applicable.
Article 8. Infrastructure of
the referendum
- The Municipal Council of DD will issue orders to Municipal
Management Service of DD to arrange the required logistic support.
During electoral day, at least a third part of municipal security
forces will be under orders of Municipal Council of DD.
- Electoral observers can be the representatives of political
parties, of the Town Council, of the Citizens' Associations and the
vouchsafers of the Promoting Committe. All of them will have to be
ratified by Municipal Council of DD at least a week before the
referendum is held.
- The electoral board of the polling stations are made up among
citizens of the town according to current electoral legislation.
Electoral observers, members and vouchesafers of the Promoting
Committe, or members of the Town Council cannot belong to a board of
polling station.
- Along electoral day the Municipal Council of DD will be
automatically called in permanent sesion, in order to resolve any
eventuality.
Article 9. Realization of the
referendum
- The decision under referendum is taken by means of individual,
free and secret vote of the citizens of the town, placed in an
electoral ballot box. The vote is accomplished within a sole electoral
day.
- The right for electoral abstention will be protected.
- The vote by mail is accomplished according to current electoral
legislation.
- Voting process in every polling station is managed by its
electoral board. Its decisions are executive inmediately, but could be
appealed before Municipal Council of DD.
Article 10. Guarantee of secret
vote
- Every electoral ballot box will have in front of it, to a
distance of two meters, a voting booth. The booths has an entry in its
rear side and an exit in its front side, designed for the voter has
privacy inside.
- Inside the booth there will be the ballots and envelopes needed
for voting.
- Use of the booth is an electoral duty; it will be not possible to
exercise the right of voting without previously to stay within the
voting booth. The voter will enter to booth when calling by name by
board of polling station, when exiting voter will go inmediately to
deposit its vote into the electoral box. Any other behaviour could be
qualified by the board as null vote.
- At the request of the board, the security forces will warrant by
means of some procedure the voting privacy of voters who due to some
kind of physical inability or of another nature could not use the
voting booth.
- In general, security forces will prevent public ostentation of
voting intention.
Article 11. Guarantee of secret
abstention
- Once official count of the electoral board have ended, lists with
name of voters generated during the electoral day are destroyed. The
security forces will warrant their irreversible destruction, and
mentioned list never leaves the electoral board.
- The security forces will prevent copies of mentioned list were
made by any way.
Article 12. Count of the
referendum
- At the end of the electoral day, every electoral board will
accomplish publicly the count. The results will be reported to
Municipal Council of DD to the provisional proclamation of the result.
- The Municipal Council of DD will warrant enough resources to get
a provisional official count taking account over the 95% of votes
within the next 6 hours after closing the polling stations.
- The decision under referendum is taken by majority. The most
voted option becomes in the decision of referendum.
- When used expression admited several numerical responses, the
numerical decision will be taken proportionally to the votes for each
option.
Article 13. Failure to comply
with binding nature
- Failure to comply with binding nature of the decision taken by
referendum will be estimated by the Municipal Council of DD.
- The Promoting Committe of the popular initiative, a 20% of the
own council and a 20% of the presidents of Citizens' Associations could
cause the deliberation of the Municipal County of DD.
- The official declaration of failure will be notified to the
judicial authority, asking for its protection and the executive
compliance of the decision of the referendum.
- The official declarations of failure will be read and transcribed
entirely in all municipally-owned communication media. They will be
also edited on edict and sent by direct personal mailing to all
citizens by the Municipal Management Service of DD. This broadcasting
campaign will be accomplished when oficial declaration of failure are
issued and at the end of the electoral campaign of the next municipal
elections too.
Chapter 3. About
general provisions for the initiative
Article 14. Initiative to the
referendum
- The initiative of calling a referendum can be exercised by the
municipal institutions and by people in the terms regulated by these
regulations.
- These general provisions are applicable to any kind of generic
initiative.
- For some kinds of initiative, these regulations will define their
peculiarities too. Mentioned specific initiatives are:
- Institutional initiative for the legislative ratification
- Popular legislative initiative
- Popular abrogative initiative
- Popular initiative revoking public post
Article 15. Institutional
initiative for referendum
- The Town Council is legitimized to initiate a calling for
referendum in the terms stated by the national and regional
legislation, and by these regulations.
- Another municipal institutions could generate an initiative if
they are explicitly legitimized by the national and regional
legislation, or by the own Town Council.
- The Municipal Council of DD will receive the petitions of the
institutional initiative.
- [SP] By legal imperative
from Article 71 of the Law 7/1985 Regulating the Foundations of Local
Regime the Major, prior authorization by absolute majority of the
Municipal Corporation, can held a popular plebiscite on issues within
municipal scope and local nature having a special interest for
citizens, with exception of issues related to local public purse. This
procedure will be used as an exception when the Major decides.
Article 16. Popular initiative
for referendum
- People of this town enjoy the political freedom to initiate the
calling for municipal referendum.
- The Municipal Council of DD will receive the petitions of the
popular initiative. The petition will be accomplished by the Promoting
Committe of the popular initiative.
Article 17. Promoting Committe
of the popular initiative
- The Promoting Committe is the citizen organization that begins
the popular initiative. Its creation and existence, as well as its
functions, rights and duties, are regulated in these regulations.
- The Promoting Committe will be comprised exclusively by physical
persons. As a minimum three members will be identified in charge of
rules of the President, Secretary and Treasurer, conforming the
direction of the committe.
- All members of the Promoting Committe should be citizens of the
town, registered in the municipal census at least two years ago.
Article 18. Submission of a
petition
- The institutions and the Promoting Committe submit the petition
of initiative for municipal referendum to the Municipal Council of DD,
with informative copy to the Town Council. It will have follow
composition, written in all official idioms of the town:
- Title or short identification of the initiative, which will
appear in future documents or in promotion.
- Kind of initiative to referendum. It can be a generic
initiative or some of the specific kinds included within these
regulations.
- Expression used by the question of the referendum, if it is not
regulated by these regulations.
- Legal texts or another nature documents which must be attached.
- Foundations of the legitimacy of the institution, if it is an
institutional initiative.
- Composition of the Promoting Committe, if it is a popular
initiative.
- The petition will be dated by the input register of the Municipal
Council of DD. Alternatively, by cases of force majeure a notarial
notification could be accomplished before the Municipal Council of DD
and before the Town Council.
Article 19. Application of a
petition
- The Municipal Council of DD will have thirty days to make public
the official existence of the initiative to referendum, or else the
nullity of the petition, after checking:
- The composition of the Promoting Committe or the legitimacy of
the institution.
- That the object of the initiative to referendum complies with
these regulations.
- That no exclusion for referendum are present.
- That the expression and associated texts complies formally with
the kind of initiative raised.
- If the specified period has passed the petition becomes
automatically initiative to referendum if there is not an official
declaration of nullity of the petition on the part of the Municipal
Council of DD. When status of initiative is reached, the petition
enjoys all rights regulated by these regulations.
- Through administrative channel, official declaration of nullity
on the part of the Municipal Council of DD is unappealable.
Article 20. Ratification of the
popular initiative
- Popular initiative has to be ratified at least by signing of 6%
of active electoral body. Ratification by an municipal elector is
accomplished by means of its sign and identification.
- Since the initiative is official, Promoting Committe will have
six months at the latest to recollect needed signs in sheets. Once
mentioned term has passed it will be understood the initiative has run
out.
- The empty sheets can be printed freely, by any way. Format of
sheets of signs is common for all of popular initiative;
initiative-specific sheets will be never required. They will be printed
in all official idioms of the town.
- If there are associated texts associated to the initiative, the
citizen will be provided with copy previously to ratification.
- The empty sheets has space to contain only following data:
- Title and kind of initiative.
- Expression used by the question of the referendum.
- Sign, name, surnames, identification and address of every
citizen. Its sign ratifies the initiative and the knowledge of the
associated texts if any. Every sheet will have space for thirty
citizens exactly.
- The act of ratification is accomplished by means of signing,
physically before voucher.
Article 21. Vouchers of the
ratification of the popular initiative
- In every popular initiative, the Municipal Management Service of
DD will appoint at least two vouchers among its municipal officiers.
The citizens will be able to ratify the initiative in the facilities of
the own Municipal Management Service of DD.
- Promoting Committe will be able to appoint its own vouchers among
citizens of the town.
- Within first fifteen days, all vouchers will take the oath to
testify before Municipal Council of DD, or alternately before
notary. Their oath will be kept validity while the initiative had not
run out. A voucher is subjected to penal responsability derived from
perjury.
- Subsequently, new vouchers could be only appointed as result of
substitution by cases of force majeure.
Article 22. Verification of the
ratification
- The collected signs for ratification of a popular initiative have
to be put to a verification process. The sheets with signs will be put
by all vouchers before Municipal Council of DD; during this act
attested copies will be made remaining in the hands of Promoting
Committe. The Municipal Council of DD will have forty five days to
verify signs.
- By cases of force majeure or failure of periods, the verification
could be accomplished by a notary at the request of Promoting
Committe.
- Randomly, on a subset no lower than 3% of the signs, direct
verification will be accomplished before the elector who ratified the
initiative, taking the oath on its ratification.
- If the number of electors which cannot be get hold of is over
10%, or if more than 3% of electors refuse to be taken the oath, the
periods of the initiative will keep suspended, reporting the facts to
judicial authority as supposed electoral crime of fraud or boycott.
Judicial sentence could cancel or resume the initiaitive, as well as to
repeat the verification process. Under mentioned percent figures the
initiative will be not suspended, but the Municipal Council of DD could
report the facts to judicial authority to investigate individual
responsabilities
- A popular initiative will be not considered ratified without its
respective verification. Once popular initiative is ratified, the
Promoting Committe cannot withdraw it.
Article 23. Calling for
referendum
- Declaration of official existence of an institutional initiative,
or ratification of a popular initiative provokes teh automatic calling
for its referendum.
- In order to guarantee enough time for public debate the length of
campaign is 180 days, holding the referendum the first holiday once
campaign passed.
- The Municipal Council of DD will give Municipal Management
Service of DD needed orders to hold the referendum. By cases of force
majeure or failure of periods the calling institution or the Promoting
Committe will be legitimized to manage temporarily the celebration,
counting, proclamation of results of the referendum, that will be held
the next available holiday.
Article 24. Financing of
popular initiatives
- The Promoting Committe will receive, as compensation of expenses
for ratification of popular initiative, a fixed amount equal to 1% of
yearly budget of DD set aside for financing of popular initiatives.
- The Promoting Committe will receive, as compensation of expendses
for campaign of referendum of a popular initiative, a fixed amount
equal to 4% of yearly budget of DD set aside for financing of popular
initiatives.
- Both amounts will be met by Municipal Management Service of DD
within five days next to official ratification of popular initiative.
Chapter 4. About institutional initiative for
legislative ratification
Article 25. Institutional initiative for legislative ratification
- The Town Council can hold a referendum on legislative texts,
regulations or municipal normative before coming into effect. Previous
general provisions to the initiative will be applicable, together with
following specific regulations.
Article 26. Petition of the
institutional initiative for lesgislative ratification
- The Town Council will address the petition to the Municipal
Council of DD that will contain the legislative text written as
normative set of regulations.
Article 27. Question of
referendum
- The text of the question of referendum will be: "As expression of Constituent Power held by
me, I opt for: A) Ratifying the legislative text proposed by the Town
Council, B) Refusing the legislative text".
Article
28. Publicity of legislative text
- During the campaign of referendum the municipally-owned
communication media will be obliged to publish the complete legislative
text every 60 days and within the week before the referendum.
- During the campaign of referendum the municipally-owned
audiovisual communication media will be obliged to hold
debates every 60 days and within the week before the referendum.
- The Municipal Management Service of DD will publish by means of
printed proclamation, data media and data networks the legislative text.
- The complete legislative text will remain displayed, at visible
position, at the entrance of the polling stations during the referendum
day.
Chapter 5. About
popular legislative initiative
Article 29. Popular legislative
initiative
- People of this town enjoy the political freedom to introduce
legislative texts, regulations and rules applied to municipal scope.
Previous general provisions for initiative, together following specific
provisions, will be applicable.
Article 30. Petition of the
popular legislative initiative
- The petition of the popular legislative initiative will include
the legislative text, written as normative article set.
Article 31. Institutional
counter-proposal
- Town Council can introduce an alternative legislative text. It
has to be notified to the Municipal Council of DD within the next
thirty days after the official ratification of the popular initiative.
The institutional counter-proposal cannot be withdrawn later.
- The Municipal Council of DD could reject the institutional
counter-proposal if it considers the proposal is not an alternative
text or it includes issues outside of the popular initiative.
Promoting Committe could request the council to pronounce on. Through
administrative channel, its decision is unappealable.
- The institutional counter-proposal will be voted on referendum,
as an alternative to the complete text of the popular initiative.
Article 32. Question of
referendum
- If there is an institutional counter-proposal, the text of the
question of the referendum is: "As
expression of Constituent Power held by me, I opt for: A) Supporting the legislative text
proposed by the Promoting Committe, B) Supporting the legislative text
proposed by the Town Council, C) Rejecting both legislative texts".
- If there is noy an institutional counter-proposal, the text of
the question of the referendum is: "As
expression of Constituent Power held by me, I opt for: A)
Supporting the legislative text proposed by the Promoting Committe, B) Rejecting the legislative text".
Article 33. Publicity of
legislative texts
- The vouchers hand over a copy of legislative text proposed by the
Promoting Committe to everybody being to ratify the popular initiative,
as act before signing.
- During the campaign of referendum the municipally-owned
communication media will be obliged to publish the complete legislative
texts every 60 days and within the week before the referendum.
- During the campaign of referendum the municipally-owned
audiovisual communication media will be obliged to hold
debates every 60 days and within the week before the referendum.
- The Municipal Management Service of DD will publish by means of
printed proclamation, data media and data networks the legislative
texts.
- The complete legislative texts will remain displayed, at visible
position, at the entrance of the polling stations during the referendum
day.
Chapter 6. About
popular abrogative initiative
Article 34. Popular abrogative
initiative
- People of this town enoy the political freedom to abrogate
legislative texts, regulations and rules applicable to municipal scope.
Revocation of decisions of Town Council or another municipal
institution could be also object of this kind of initiative.
- Los ciudadanos de este municipio disfrutan de la libertad
política de revocar textos legislativos, reglamentos y normativa
aplicable al ámbito municipal. La revocación de
decisiones de la Corporación Municipal o de cualquier otra
institución municipal son también objeto de este tipo de
iniciativa. Serán de aplicación las anteriores
disposiciones generales a la iniciativa, junto con las siguientes
disposiciones especificas.
- La iniciativa popular abrogatoria no suspende la vigencia de
los textos legislativos y decisiones institucionales. Sólo
el carácter vinculante del resultado del referéndum
podrá motivar a las instituciones municipales para la
abrogación.
Artículo 35.
Petición de la iniciativa popular abrogatoria
- La petición a iniciativa popular abrogatoria
contendrá la lista de abrogación, es decir los textos
legislativos y decisiones institucionales que contempla la iniciativa
popular; dicha lista deberá guardar alguna coherencia
temática.
- Los contenidos de la lista de abrogación serán
identificados literalmente, con expresión de cuándo
entraron en vigor cada uno de ellos.
Artículo 36.
Abrogación previa al referéndum
- Si las instituciones municipales revocarán todos los
contenidos de la lista de abrogación antes de la
celebración del referéndum, la Junta Municipal de DD a
petición de la Comisión Promotora dejará la
iniciativa popular y los plazos consumidos en suspenso.
- Durante dos años la Comisión Promotora podrá
solicitar la reactivación de la iniciativa popular si considera
que concurren nuevamente los motivos que generaron la iniciativa
popular. Transcurrido este plazo la iniciativa se considerará
caducada.
Artículo 37. Pregunta al
referéndum
- El texto de la pregunta bajo referéndum es: "Como expresión del Poder
Constituyente que ostento, opto por: A) Revocar el conjunto normativo y
las decisiones institucionales propuesto por la Comisión
Promotora, B) Rechazar la propuesta de la Comisión Promotora".
Artículo 38. Publicidad
de los contenidos de la lista de abrogación
- Los fedatarios harán entrega a cada persona que desee
ratificar la iniciativa popular de una copia de los contenidos de la
lista de abrogación, como acto previo a la firma.
- Durante la campaña del referéndum los medios de
comunicación impresos de titularidad pública
estarán obligados a la publicación de los los contenidos
íntegros de la lista de abrogación cada 60 días y
dentro de la semana previa al referéndum.
- Durante la campaña del referéndum los medios de
comunicación audiovisuales de titularidad pública
estarán obligados a la celebración de debates cada 60
días y dentro de la semana previa al referéndum.
- El Organo Municipal Gestor de DD publicará mediante bando
impreso, soporte informático y redes de datos los contenidos de
la lista de abrogación.
- Los contenidos de la lista de abrogación
permanecerán expuestos, en lugar visible, a la entrada de los
colegios electorales durante la jornada del referéndum.
Capítulo 7. De la iniciativa popular
revocatoria de cargo público
Artículo 39. Iniciativa popular revocatoria
- Los ciudadanos de este municipio disfrutan de la libertad
política de revocar cargos públicos, electos o no
electos. Serán de aplicación las anteriores disposiciones
generales a la iniciativa, junto con las siguientes disposiciones
especificas.
- Cuando la iniciativa popular pretenda la revocación de un
cargo electo, deberá ser presentada de forma que su
referéndum ocurra al menos 90 días antes de la
finalización de su mandato.
- Si la legislación nacional o regional prohibe alguna forma
de revocación popular de cargos electos, el referéndum
tomará el carácter de moción popular de censura.
Artículo
40. Petición a la iniciativa popular revocatoria
- La petición a iniciativa popular revocatoria
contendrá la lista de cargos públicos que se desea
revocar, con expresión de la fecha y origen del cargo
público que posee.
Artículo 41.
Revocación previa al referéndum
- Si todos los cargos públicos que contempla la iniciativa
popular cesan en sus funciones antes de la celebración del
referéndum, la Junta Municipal de DD a petición de la
Comisión Promotora dejará la iniciativa popular y los
plazos consumidos en suspenso.
- Durante dos años la Comisión Promotora podrá
solicitar la reactivación de la iniciativa popular si considera
que concurren nuevamente los motivos que generaron la iniciativa
popular. Transcurrido este plazo la iniciativa se considerará
caducada.
Artículo
42. Pregunta al referéndum
- El texto de la pregunta bajo referéndum será: "Como expresión del Poder
Constituyente que ostento, opto por: A) Revocar la lista de cargos
públicos propuesta por la Comisión Promotora, B) Rechazar
la propuesta de la Comisión
Promotora".
Capítulo 8. De las instituciones municipales de
DD
Artículo 43. Junta
Municipal de Democracia Directa
- La Junta Municipal de DD es la máxima autoridad municipal
en relación a la gestión y protección de las
libertades de Democracia Directa. Este reglamento desarrolla sus
funciones, así como los mecanismos de cooperación con la
Corporación Municipal.
- La Junta Municipal de DD redactará y aprobará su
propio reglamento interno, que incluirá la elección de su
Presidente y otros cargos organizativos.
- Las decisiones se toman por mayoría simple, con voto de
calidad del Presidente.
- Todas sus reuniones y decisiones son públicas.
Artículo
44. Organo Gestor Municipal de Democracia Directa
- El Organo Gestor Municipal de DD es el órgano
técnico responsable de la ejecución, logística y
administración presupuestaria de los actos derivados del
ejercicio de las libertades políticas de DD.
- Depende orgánicamente de la Junta Municipal de DD y
administrativamente de la Corporación Municipal que aporta el
personal técnico funcionario.
- La Junta Municipal de DD planificará en cada momento sus
necesidades de personal, con garantía de hasta un 4% del
personal técnico funcionario del municipio. Nombra o cesa
libremente al máximo responsable del órgano gestor, entre
el personal técnico funcionario.
Artículo 45. Presupuesto
municipal de DD
- La Junta Municipal de DD planificará el presupuesto del
Organo Gestor Municipal de DD. Recibirá una aportación
fija no inferior al 1% del presupuesto municipal, y otra
aportación retornable no inferior al 2% del presupuesto
municipal para la financiación de campañas de iniciativas
populares.
- La Junta Municipal de DD invertirá al menos el 10% de su
presupuesto fijo en campañas anuales de información de
las libertades políticas de DD en asociaciones de vecinos,
centros educativos, etcétera.
Artículo 46.
Composición de la Junta Municipal de DD
- La Junta Municipal de DD está compuesta por representantes
de diferentes cuerpos, que deberán estar empadronados con una
antigüedad mínima de dos años en el momento de ser
nominado como candidato.
- La nominación de candidatos se realizará ante la
propia Junta Municipal de DD, o en su primera constitución ante
la Corporación Municipal, que estimará si reunen las
condiciones para su candidatura. En vía administrativa, su
decisión es inapelable.
Artículo 47. Cuerpo
político de la Junta Municipal de DD
- En función de los resultados electorales, los partidos
políticos, coaliciones o agrupaciones de electores que se
presenten a las elecciones municipales aportarán un total de
cinco miembros a la junta, utilizando un criterio proporcional puro sin
cuotas mínimas.
- La nominación de cada lista completa de candidatos para la
Junta Municipal de DD coincidirá en fecha y plazos con la
nominación de candidatos para la Corporación Municipal.
No se podrá ser simultáneamente candidato para ambas
instituciones. Aquellas listas no presentadas provocarán
vacantes.
- Los candidatos se convertirán en miembros de la Junta
Municipal de DD cuando la autoridad electoral proclame los resultados
definitivos de las elecciones municipales.
- La renuncia voluntaria de estos miembros provoca vacante y
sólo podrán ser sustituidos por causas de fuerza mayor,
estimada por la Junta Municipal de DD.
Artículo 48. Cuerpo
asociativo de la Junta Municipal de DD
- Los presidentes de las Asociaciones de Vecinos de cada distrito,
reguladas por el Reglamento de Participación Ciudadana,
serán miembros natos de la junta. Existirá un
máximo de ocho miembros de este cuerpo.
- Se adquiere o se pierde la condición de miembro de la
junta con la condición de presidente de la Asociación de
Vecinos del distrito. Será requisito estar empadronado con una
antigüedad mínima de dos años para incorporarse a la
junta.
- Si existiesen más distritos que el máximo
número de miembros, se rotará cambiando uno de los
miembros cada año. La renuncia, inexistencia o falta de
antigüedad de un presidente provoca la rotación.
- Todos los presidentes de las Asociaciones de Vecinos de cada
distrito pueden asistir a las reuniones de la Junta Municipal de
DD, con derecho a voz. El reglamento interno de la junta podrá
regular derechos adicionales.
Artículo 49. Cuerpo
participativo de la Junta Municipal de DD
- Los vecinos que hubiesen dirigido la Comisión Promotora de
alguna iniciativa popular podrán constituirse en asamblea. Se
requerirá que la iniciativa popular haya alcanzado la
ratificación mínima de firmas exigida por este reglamento.
- Este derecho se adquiere a título vitalicio, y sólo
se perderá al causar baja en el padrón municipal.
- Cada cuatro años la Junta Municipal de DD convocará
esta asamblea para elegir miembros de la junta entre los integrantes de
la asamblea, que libremente podrán presentarse candidatos hasta
diez días antes. La asamblea utilizará el sistema
electoral de Voto Personal Transferible para elegir hasta tres miembros
y tres suplentes para la Junta Municipal de DD.
- Todos los integrantes de la asamblea pueden asistir a las
reuniones de la Junta Municipal de DD, con derecho a voz. El
reglamento interno de la junta podrá regular derechos
adicionales.
